1. Agreement
These Terms of Service govern your membership and use of the facilities, training, fleet, and digital services of Yelken G Sailing Academy & Yacht Club (“the club”, “we”, “us”). By accepting membership, registering for a training programme, or participating in a club race, you agree to these terms.
2. Membership and services
We offer club membership, structured training programmes (including junior sailing), access to club fleet boats under supervision, race and regatta administration, and a crew marketplace for members. Specific eligibility, equipment, and supervision requirements are documented in the Akademi Kuralları.
3. Conduct on the water and on shore
Members must follow skipper instructions on the water and the academy rules at all times. We may suspend or terminate membership for breach of safety obligations, falsified health declarations, harassment, or non-payment of dues.
4. Fees, refunds, and cancellation
Membership dues and programme fees are payable in advance under the schedule published at registration. Cancellation and refund rights for distance-sold programmes follow applicable Turkish consumer protection law. Detailed terms are issued at registration.
5. Fleet use and equipment
Use of club boats and equipment is subject to skipper qualification and supervision rules. Damage caused by negligence is invoiced to the responsible member. The skipper signs off equipment condition before and after every session.
6. Acknowledgement of risk
Sailing carries inherent risks (drowning, injury, exposure, equipment failure). The club provides instruction and supervision but cannot eliminate risk. Members and guardians of junior members accept this risk on registration.
7. Limitation of liability
To the maximum extent permitted by Turkish law, our liability for any claim arising from membership or participation is limited to the fees paid by the affected member in the twelve months preceding the claim, save where liability cannot be limited by law (including death or personal injury caused by negligence).
8. Data and KVKK
We act as data controller for personal data processed in connection with membership and participation. Our processing is described in the Gizlilik Politikası and the KVKK Aydınlatma Metni.
9. Force majeure
We are not liable for delay or non-performance caused by events beyond our reasonable control, including weather, public health measures, regulatory action, or harbour closures. We will reschedule training where reasonably practicable.
10. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The Turkish courts have exclusive jurisdiction over disputes, save where mandatory consumer protection provisions provide otherwise.
